Collection & Transmission for Private Pay Patients (non-Medicare/non-Medicaid)
The Centers for Medicare and Mediciad Services (CMS) issued the attached letter to inform State Survey Agencies of the elimination of OASIS requirements for non-Medicare and non-Medicaid patients. In addition to providing information about suspension of OASIS requirements, the letter includes a reminder that home health agencies must continue to conduct comprehensive assessments at all time points specified in the Conditions of Participation at 484.55 on non-Medicare and non-Medicaid patients. CMS issued the instructions based on the December 8, 2003 signing of the Medicare Reform Act legislation, rather than Administrator Tom Scully's announcement of a temporary suspension of OASIS for non-Medicare and non-Medicaid patients made at the November 5, 2003 Open Door Forum. However, NAHC confirmed CMS' intention to honor the elimination of these OASIS requirements beginning November 5, 2003. CMS staff have agreed to provide direct assistance to home health agencies if they have problems with surveyors who refuse to honor the November 5th effective date for elimination of OASIS requirements for non-Medicare and non-Medicaid patients.
